ICTK Terms and Conditions
The ICTK Terms and Conditions outline the rules for the provision of services, technical requirements, and the rights and obligations of individuals using our platform.
DEFINITIONS
- Blog: A website at blog.ictk.pl operated by ICTK, where ICTK publishes content related to mental health.
- Price List: A catalog defining the cost of specific sessions available to clients on the ICTK Platform.
- Personal Data: Any information related to an identified or identifiable natural person (“data subject”); an identifiable person can be identified, directly or indirectly, by reference to identifiers like name, ID number, location data, IP address, or one or more of these characteristics describing the natural person in question – physical, physiological, genetic, psychological, economic, cultural or social identity.
- Schedule: The availability calendar of a Specialist, which allows for booking a session.
- Internet Center for Short-term Therapy, (“ICTK” or “us”): Short for Internetowe Centrum Terapii Krótkoterminowej, a registered entity operating under ICTK Prosta Spółka Akcyjna with headquarters in Warsaw, Nowogrodzka 56A, 00-695, entered into the registry of enterprise maintained by the District Court for the city of Warsaw, in Warsaw, 12th Commercial Division of the National Court Register with the KRS number: 0001058111, REGON: 526412310, NIP: 7011164909, equity capital 10.000,00 PLN. ICTK operates the website at www.ictk.pl.
We provide Services and access to online events through the ICTK Platform. More information about all of the services can be found in our Terms and Conditions or our website at www.ictk.pl.

- Civil Code: law dated April 23, 1964, Civil Code;
- Consumer: Any User who uses the ICTK Platform for purposes not directly related to their business or professional activities.
- Account: A free service provided by ICTK, through which the Client uses the ICTK Platform with their individual Client profile.
- Client: A person using psychological or psychotherapeutic services provided by a Specialist through the ICTK Platform.
- Therapeutic Contract: Covers the principles of the relationship between the Client and the therapist and aims to protect the interests of both parties. It defines the rules of psychotherapeutic work and constitutes a declaration of the Client’s intent to participate in therapy and their understanding of what this decision entails.
- Client: A person using psychological or psychotherapeutic services provided by a Specialist via the ICTK Platform.
- Privacy Policy: Refers to the Privacy Policy available at www.ictk.pl/polityka-prywatnosci, which forms an integral part of these Terms and Conditions.
- ICTK Platform: The online system available at www.ictk.pl, administered by ICTK, through which users can Book Sessions with a Specialist or use other services specified in the Terms and Conditions. Registration of an Account by the Client is necessary to gain access to the ICTK Platform.
- Terms and Conditions: Refers to these ICTK Terms and Conditions.
- Registration: The process of creating an Account in ICTK, accepting ICTK Terms and Conditions is a mandatory element of Registration.
- Booking: The User’s booking of a Session with a Specialist via the ICTK Platform.
- Session: A paid online meeting between a Specialist and a Client via the ICTK Platform. The Client can choose the type of Session— all available Session types are visible on the ICTK website.
- Force Majeure: Refers to extraordinary, external, and independent events beyond the control of the parties, which cannot be prevented or effectively countered, including such events as fires, earthquakes, floods, epidemics, natural disasters, states of emergency, war, military actions, terrorist attacks, and strikes.
- Provision of electronic services: Refers to the performance of a service rendered without the simultaneous presence of the parties (i.e., remotely), through the transfer of data at the individual request of the service recipient, transmitted and received using electronic data processing devices, including digital compression and data storage, transmitted in full via a telecommunications network as defined in the Act on the provision of electronic services.
- Specialist: A person specializing in a specific type of therapy as described on the ICTK website, providing psychological or psychotherapeutic services to Clients via the ICTK Platform.
As an online therapy center, ICTK states that the Specialists working with them, who provide psychotherapy services, hold a master’s degree in psychology or an equivalent qualification. They have also either completed or are currently undergoing certification training in Solution-Focused Brief Therapy (SFBT). Additionally, these professionals possess the necessary knowledge and skills to offer psychological and psychotherapeutic services at the highest standard.
- Digital Content: All webinars, training sessions, e-books, or other materials constituting digital content related to mental health available on the ICTK Platform, free of charge unless otherwise stated on the ICTK Platform.
- Subscriber: A User who has entered into an agreement with ICTK for the delivery of a Newsletter.
- ICTK Service: Refers to the ICTK website available at www.ictk.pl.
- Electronic Service Agreement (“Agreement”): Refers to an agreement for the provision of electronic services related to the use of the ICTK Platform, concluded between ICTK and the User.
- Service: Services provided electronically by ICTK, in particular making the ICTK Platform functionalities available for using psychological and psychotherapeutic services provided by Specialists, as well as access to ICTK Digital Content.
- Psychological or psychotherapeutic service: A service involving the provision of psychological or psychotherapeutic assistance to the Client, carried out by a Specialist via the ICTK Platform.
- Act on the Provision of Electronic Services: Refers to the Act of July 18, 2002, governing electronic services.
- User: A person with full legal capacity, who uses the ICTK Platform and enters into an Agreement with us.
- Voucher: A code that entitles the holder to use ICTK services for free or at a specified fee.
1. WHO WE ARE AND WHAT WE DO
1. ICTK Platform is an online platform through which Specialists provide psychological or psychotherapeutic services to Clients.
2. This document outlines the conditions and terms for using the ICTK Platform, including specifics on the provision of services via electronic means.
3. If you need to contact us, you can reach out via email at kontakt@ictk.pl or call us. We aim to respond promptly to all inquiries.
4. ICTK Platform Terms and Conditions defines:
- Types and scope of services provided by the ICTK Platform
- Conditions for providing services electronically, including the technical requirements necessary to use Services.
- Terms of concluding and terminating electronic service agreements
- Complaint handling procedures
- Rights and obligations of users
- Responsibilities of ICTK and the Specialists
- When using the ICTK Platform, services are provided electronically as per the Act on the Provision of Electronic Services.
- Services are provided based on the terms set out in the Terms and Conditions and the Act on the Provision of Electronic Services. Any breach of the Terms by the User will have consequences as specified in the Terms and the Act, along with other applicable laws.
- Users are required to familiarize themselves with the information provided in the Terms and Conditions before using any of ICTK’s services.
- ICTK, as an online platform operator, does not provide or mediate in providing health services as defined by the Act of April 15, 2011, on Medical Activity.
- Users utilize psychological and psychotherapeutic services at their own request and are responsible for their decisions and actions.
- During sessions, Specialists may recommend that a Client seek assistance from another professional, such as a psychiatrist. The Client is obliged to take these recommendations into account in their future actions.
2. THERAPEUTIC CENTER
1. ICTK allows Users to access the following services available on the ICTK Platform:
- Specialist search tool;
- Online psychological or psychotherapeutic support during a Session with a selected Specialist;
- Account;
- Newsletter;
- Blog;
- Digital content.
2. Services such as the Account, Newsletter, Blog, and Digital Content provided by ICTK are free, unless otherwise indicated on the ICTK website.
3. Online psychological services are paid. The fee depends on the specific Session chosen by the Client. The Price List for individual sessions is available on the ICTK website.
4. Depending on the specific service, it will be available to you after registering an Account on the ICTK Platform, after making a payment, or without the need to create an account, by using the ICTK Platform functionalities.
5. Psychological or psychotherapeutic services are provided during a session in the form of an online conversation with a Specialist via the ICTK Platform.
6. A detailed description of individual services can be found on the ICTK Platform website. ICTK may introduce new services, but this will not entail a change in the Terms and Conditions unless necessary. The service of contacting a supervisor of a psychological or psychotherapeutic service is free. It consists of a telephone or online consultation aimed at analyzing the Client’s needs regarding psychological or psychotherapeutic services.
3. TECHNICAL REQUIREMENTS
1. To use the Services available on the ICTK Platform, you must have the following:
- A mobile device or equipment that supports audiovisual connections (speaker, microphone, camera);
- Internet access that allows for audio-video calls;
- An updated web browser (one of the following): Firefox, Chrome, Safari, or Microsoft Edge;
- An active email address.
2. ICTK notes that the email address is linked to the Account and is necessary for identifying the User with ICTK. It will be used for all correspondence between ICTK and the User related to providing Services. The email is provided during Account Registration. The User is required to monitor this email regularly and update it promptly in their Account settings if it changes.
3. ICTK is committed to providing continuous and uninterrupted services but reserves the right to:
- Send technical, legal, and transactional communications related to the operation of the services via email and the ICTK Platform Account;
- Refuse service if the User violates the Terms and Conditions;
- Temporarily suspend services for technical maintenance or modifications of the ICTK Platform;
- Modify services, including the operation of the ICTK Platform, based on changes to the Terms and Conditions.
4. Users can manage their Account and privacy settings, including personal data, at any time through the Account settings on the ICTK Platform.
5. In the event of a malfunction or disruption that impairs or prevents the use of services or the ICTK Platform, ICTK will promptly take steps to resolve the issue.
4. ACCOUNT
1. The agreement for providing services to an unregistered user is concluded upon the User’s Account Registration on the ICTK Platform. To avoid any doubts, the Agreement becomes effective upon the receipt of the Account Registration confirmation, which ICTK will send to the email address provided during Registration.
2. Upon entering into the Agreement, the User agrees to comply with the Terms and Conditions and provide true and accurate information when using the ICTK Platform functionalities.
3. The Agreement for the provision of electronic services is concluded for an indefinite period and is governed by these Terms and Conditions.
4. ICTK ensures that Users have access to their personal data and the ability to modify and update it.
5. In cases where there are reasonable doubts regarding the authenticity of the User’s data, ICTK reserves the right to request appropriate documents to verify the data.
6. On the ICTK Platform, it is not allowed to:
- Have more than one Account per User, except in special situations such as having both a personal account and one for services for a minor.
- Share the Account with third parties, except in specific situations such as couples therapy.
- Use another User’s Account, except in special circumstances such as therapy for a minor
7. The User can terminate the Agreement for electronic services at any time by deleting their Account from the ICTK Platform. To delete the Account, the User must send a request to: kontakt@ictk.pl, including their username (email address used during registration) and full name in the email content.
8. ICTK reserves the right to terminate the Agreement with immediate effect by deleting the User’s Account under the following circumstances:
- The User uses the Account in a manner that is illegal, violates the Terms, or harms the reputation of ICTK;
- The User does not accept changes to the Terms.
9. Account registration is completed via the ICTK Platform, requiring basic information such as an email address and Account password. During registration, it is also necessary to accept the Terms and Conditions. Registration will be confirmed by an email containing an activation link sent to the email address provided by the User during Registration.
10. To create an Account and use the Services or log in for a Session, the User must be 18 years old and have full legal capacity. For Users who are minors or legally incapacitated, consent from their legal representative is required for Account creation and use of Services via the ICTK Platform. By Registering, the User confirms that this consent has been given. ICTK may request relevant documents to verify this data immediately after Registration, and the User is obliged to provide them to ICTK or the Specialist no later than the first Session.
11. If a User forgets their Account password on the ICTK Platform, they can use the “Forgot Password” form, and ICTK will send an email with a link to reset the password to the email associated with the Account.
12. ICTK is not responsible for any damage incurred by the User due to providing false or incorrect information during Registration. ICTK does not verify the authenticity of the data provided by the User. The User bears sole responsibility for using their Account, including the password provided during Registration. ICTK is not liable for any damages arising from the disclosure, theft, or misuse of the login details for the ICTK Platform. In such a case, the User is required to change their login password via the ICTK Platform.
5. HOW TO BOOK, RESCHEDULE, OR CANCEL A SESSION WITH A SPECIALIST?
Booking a Session
1. A psychological or psychotherapeutic Service is a conversation between the Client and the Specialist, conducted during a Session via the ICTK Platform.
2. The User acknowledges that psychological or psychotherapeutic Services are provided by Specialists.
3. ICTK notes that the information about Specialists visible on the ICTK Website is for informational purposes only.
4. The User finds a suitable Specialist using the search engine and books a Session according to the Specialist’s Schedule via the ICTK Platform. The selected Session time is booked and blocked in the Schedule, and the booked Session will appear in the Client’s Account.
5. The selected Session time is reserved for the Client for a maximum of 48 hours before the 6. Session, unless the Client pays for the Session within that time. If no payment is made, the reservation is canceled.
6. The duration of the Session depends on its type. All available types of Sessions are described on the ICTK Website.
7. Sessions can be booked at least 24 hours in advance.
8. After booking, the User proceeds to pay for the Session. Payment for the Session must be made no later than 48 hours before the Session begins. For this purpose, the User will receive a payment reminder via email or SMS to the phone number provided in the Client’s Account. Detailed payment rules are described in section 6 of the Terms and Conditions.
9. Once payment is made, the User will receive a confirmation of the Booking sent to the email address provided during Registration. To attend a Session with a Specialist, the Client should log in to the ICTK Platform. A link to the online Session with the Specialist will be available in the Client’s Account.
10. Sessions are conducted by Specialists cooperating with ICTK. ICTK notes that in the case of psychotherapeutic services, the Client, upon starting a Session with a Specialist, agrees to familiarize themselves with the Therapeutic Contract presented by the Specialist.
11. During the Session, the Client and the Specialist can agree on the number and dates of subsequent Sessions. In such a case, the Specialist will book the Sessions for the Client according to their Schedule.
Rescheduling a Booking
1. The User has the right to reschedule the Booking free of charge, but no later than 24 hours before the start of the Session. The rescheduling is done via the Account on the ICTK Platform.
2. Rescheduling in any other way than indicated in section 1 is not possible, and in such a case, the payment for the Session will not be refunded.
3. In the event of a reschedule, the User will receive confirmation of the new Booking date via email or SMS to the phone number linked to the Account.
Canceling a Booking
1. The User has the right to cancel a Booking free of charge, but no later than 24 hours before the start of the Session. In such a case, the payment for the canceled Session may be used for a future Booking on the ICTK Platform. If the User does not wish to use the funds for another Booking, they will receive a refund in the same manner as the original payment for the Session.
2. If the deadline for free cancellation is missed, the payment for the Session will not be refunded.
3. In special cases, ICTK may decide to refund the payment for a canceled Booking. Each case will be analyzed individually, and the User should contact ICTK via email at kontakt@ictk.pl.
4. If the User does not cancel the Booking and does not attend the Session, the payment for the Session or the Voucher used to pay for it at the time of Booking will be forfeited as compensation for reserving the Session for the benefit of the Specialist and ICTK.
5. If the Booking is canceled by the Specialist or due to ICTK’s fault, and a new Booking date is not arranged with the User, the User will receive a refund in the same manner as the original payment for the Booking. If the payment was made with a Voucher, the User will be able to use it for a future Booking of the same value.
6. PAYMENTS
1. The User has the option to choose from the following payment methods for paid Services:
- Electronic bank transfer via PayU;
- Payment by debit/credit card via PayU;
- Blik;
- ICTK Voucher.
2. The payments mentioned in points a) and b) above are made by the Client via the PayU.pl service, offered by PayU SA, located at Grunwaldzka Street 182, 60-166 Poznań, registered in the Register of Enterprise maintained by the District Court Poznań – Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register under KRS number 0000274399, with equity capital of PLN 4,000,000, fully paid, and a tax identification number NIP: 779-23-08-495, REGON 300523444. Electronic payments are processed in accordance with the rules specified in the electronic payment regulations available at: www.payU.pl.
3. The User makes the payment according to the selected type of Session and the Price List, which is available on the ICTK Website. For other paid Services, the price will be indicated on the ICTK Website.
4. After completing the payment, the User will receive a confirmation sent to the email address provided during Account Registration. A confirmation will also be sent for payments made with a Voucher.
5. ICTK notes that the Session Price List applies to all Users. Any price differences may result from another entity or the User’s employer entering into an agreement with ICTK, where they agree to cover part of the paid Service cost on behalf of the User. Therefore, ICTK does not offer individual price adjustments for paid Services for Users.
6. ICTK reserves the right to verify relevant documents (e.g., a student ID) entitling certain User groups (e.g., students) to discounts.
7. RIGHTS AND OBLIGATIONS
1. The User is responsible for the security and confidentiality of their Account password. ICTK is not liable for unauthorized access to the Account if such access occurred due to the User disclosing their password to third parties.
2. In case of suspicion that the password has been disclosed to third parties, the User is required to immediately change their password via the ICTK Platform or contact ICTK at the email address kontakt@ictk.pl.
3. The User is fully responsible for any legal violations or damages caused by their actions that harm ICTK, particularly for providing false information, disclosing professional secrets, other confidential information, or trade secrets, and for infringing personal rights or intellectual property rights.
4. If there is a change in the User’s email address, contact details, banking information, or any other data required for the execution of the Agreement, the User must promptly inform ICTK via email at kontakt@ictk.pl.
8. COMPLAINTS
1. The User has the right to file a complaint regarding the functionality of the ICTK Platform and the Services provided through it.
2. A properly submitted complaint should include at least the following:
- The complainant’s identification (name, surname or company name, home or business address, and email address),
- The subject of the complaint,
- Circumstances justifying the complaint,
- The expected resolution.
3. Complaints can be submitted via email to kontakt@ictk.pl or by traditional mail to the ICTK headquarters address.
4. If the information provided in the complaint needs to be supplemented for proper consideration, ICTK will ask the User via the provided email address to provide the necessary details within a specified scope and time frame.
5. ICTK reviews the complaint within 14 days from the date of receipt. A response to the complaint is sent to the address or email provided by the User.
6. In case of a dispute between ICTK and the User, the User has the option to use alternative dispute resolution methods instead of court proceedings, particularly through mediation, conciliation, or arbitration (arbitration court). A list of institutions that the User can contact to resolve disputes can be found here: https://uokik.gov.pl/rejestr_podmiot_uprawnionych.php.
7. The User may also use out-of-court methods to resolve complaints and seek claims by submitting a complaint through the EU’s online platform, available at: http://ec.europa.eu/consumers/odr/.
8. If the User chooses not to use the methods described above, any disputes between the User and ICTK will be resolved by a court, with jurisdiction determined in accordance with applicable laws.
9. ICTK’S LIABILITY
1. ICTK is liable to the User for the functioning of the ICTK Platform and access to the Services.
2. ICTK is not liable for damages caused by improper use of the ICTK Platform or Account by the User, particularly due to:
- Force Majeure;
- Actions by third parties (e.g., cyberattack, power outage, telecommunication failure);
- Actions by the User or Specialist (e.g., inappropriate equipment);
- Power or connectivity failure.
3. ICTK is also not liable for any damages caused by limitations or interruptions in the availability of the ICTK Platform or Account, especially due to:
- Force Majeure;
- Actions by third parties (e.g., cyberattack, power outage, telecommunication failure);
- Actions by the User or Specialist (e.g., inappropriate equipment);
- Power or connectivity failure.
4. The User agrees to bear all legal consequences resulting from a breach of their obligations, such as those arising from these Terms, the Therapeutic Contract, or obligations under applicable law.
5. ICTK bears no responsibility for Sessions or other actions of the Specialist, as well as for the proper conduct of the Session. The Specialist is fully responsible for any damages caused by their Sessions or information they provide.
6. The Specialist provides psychological or psychotherapeutic services to the Client, and the Client acknowledges that the dialogue between the Specialist and the Client during such services is not intended to replace the Client’s own decision-making in accordance with their free will.
7. The information disclosed by the Client during the Session is confidential, and the Specialist is obliged to keep it secret in accordance with legal principles.
10. WITHDRAWAL FROM THE AGREEMENT
1. The User has the right to withdraw from the Agreement without providing any reason by sending a statement of withdrawal to ICTK via email at kontakt@ictk.pl or in writing to the ICTK headquarters address. The withdrawal period is 14 days from the date of the Agreement’s conclusion.
2. The User does not have the right to withdraw from the Agreement in the following cases:
- If the subject of the Agreement is access to Digital Content, provided that the User has previously consented to the provision of such content before the withdrawal period ends, via the functionality of the ICTK Platform, as stated in Article 38, 1, pt. 12 of the Consumer Rights Act. If the User does not give the consent mentioned above, access to the Digital Content will only be granted after 14 days from the date of payment.
- If the subject of the Agreement is a psychological or psychotherapeutic Service, provided that the User has previously agreed that, after the performance of the service covered by the psychological or psychotherapeutic Service, they will not be entitled to withdraw from the agreement, in accordance with Article 38, 1, pt. 1 of the Consumer Rights Act.
3. If the User’s withdrawal statement is successfully submitted, ICTK will refund the amount due within 14 days from the date the statement is delivered, using the same method that the User used for payment.
4. The above provisions of this article apply if the User enters into the Agreement as a Consumer.
11. COPYRIGHTS
1. ICTK and all components of the ICTK Platform are the subject of ICTK’s intellectual property rights, including copyrights and industrial property rights, and may constitute registered trademarks or industrial designs.
2. As a result, the User is not authorized to copy, reproduce, or distribute them unless prior written consent is obtained from ICTK for such actions. In case of infringement, ICTK will take measures to protect its rights.
12. PERSONAL DATA
1. The principles governing the processing of Personal Data by ICTK are defined in the Privacy Policy.
2. ICTK uses cookies on the ICTK website. The rules regarding cookies are outlined in the Cookie Policy (included in the Privacy Policy).
13. CHANGES TO THE TERMS AND CONDITIONS
1. ICTK reserves the right to change the Terms and Conditions for important reasons, such as changes in applicable law or modernization of the ICTK Platform’s functionality.
2. ICTK will inform the User of any changes to the Terms and Conditions via email sent to the address provided during Registration, at least 15 (fifteen) days before the new Terms and Conditions take effect.
3. If the User does not notify ICTK of disagreeing to the changes, the new version of the Terms and Conditions will apply after the indicated period.
14. FINAL PROVISIONS
1. These Terms and Conditions and the Agreement with the User are governed by Polish law.
2. In matters not regulated by these Terms and Conditions, the relevant provisions of law shall apply, in particular the Civil Code and the Act on the Provision of Electronic Services.
3. If any provision of the Terms and Conditions is found to be invalid or ineffective, this shall not affect the validity or effectiveness of the remaining provisions.
4. The governing law for these Terms and Conditions is Polish law.
5. These Terms and Conditions are effective as of February 3, 2024.
